Data recovery agreement

Version: September 28, 2026

This agreement explains how KW Data Recovery handles your device and files. Our terms of service and privacy policy also apply. If you ship your device, read our mail-in agreement.

Your device and your authority

You confirm that you own the device and data, or have the owner’s permission to request this work. Tell us about previous recovery attempts, repairs, liquid damage, and any files that matter most. Do not send passwords or private files through the contact form.

Assessment and fees

You agree to a minimum diagnostic fee of $35 CAD for assessment of your device. We will confirm the full diagnostic fee, including applicable taxes, before assessment starts. You must approve any amount above that minimum before we start. Submitting the form does not take payment or authorize recovery work.

The diagnostic fee pays for assessment. It remains due if recovery is not possible or you decline the recovery quote. We will explain any separate attempt fee, donor parts, and other charges before asking for your approval. We will identify charges that remain payable if the attempt fails.

Approval before recovery work

We will state the work, price, and files we will try to recover. We will also agree on how to return the recovered files. We will wait for your approval before recovery work or parts orders.

If the scope or price changes, we will explain the change and ask for approval before proceeding. If you decline, we will explain the return options. Charges for work you already approved and we performed may still be due.

Access to your files

We will explain what access we need and why. We will limit access to staff who need it for the agreed work. We may inspect file details or samples to check whether recovery worked. We will not browse unrelated files.

If we need a password or PIN, we will explain how to share it. We will use it only for the agreed work. If you cannot provide access, we will explain which tests or recovery steps we cannot perform. Any remote-access session needs your separate approval.

You can ask us to stop work or withdraw permission to access your files. Contact us as soon as possible. Work already performed cannot be undone, and approved charges may remain due.

Risks and limits

Recovery is a best-effort service. We cannot promise to recover every file, restore a device, or finish by a specific date. Damaged storage can fail further during assessment or recovery. Files may be incomplete, damaged, or unrecoverable.

Some work requires opening the device or using heat. We will explain the planned work and known risks before you approve it. Opening a device can affect seals, appearance, or manufacturer warranty coverage.

We will ask for separate approval before work intended to erase files. Your request is not permission to erase or reset your device. Accidental data loss can still occur when working on damaged storage.

Getting your files back

We will agree on the destination for recovered files and any storage-media charge before transfer. Check the returned files promptly and tell us about problems. Keep another copy of the files you receive. Temporary recovery copies are handled under our privacy policy; they are not a long-term backup service.

Questions and approval records

We keep your agreement version, submission time, and later work approvals with your request. Keep a copy of the agreement and your quote. Contact us if anything is unclear before approving work.
